In a major relief for Muslim women, the Supreme Court on Tuesday held triple talaq as “unconstitutional”, “arbitrary” and “not part of Islam”. The five-judge bench of Chief Justice Jagdish Singh Khehar, Justice Kurian Joseph, Justice Rohinton Fali Nariman, Justice Uday Umesh Lalit and Justice S Abdul Nazeer by a 3:2 majority judgement said there is no constitutional protection for triple talaq. Justices Joseph, Nariman and UU Lalit held that triple talaq is not integral to Islam, is banned in law and lacks approval of the Shariat. However, Chief Justice Khehar and Justice Nazir, in a minority judgment, said triple talaq is integral to Islamic practices and enjoys constitutional protection. Triple talaq is the “worst” and “not a desirable” form of dissolution of marriage among the Muslims, even though there were schools of thought which called it “legal”, the Supreme Court observed today. The second day of the day-long hearing on the matter also saw two veterans, jurist Ram Jethmalani and former Union Minister and Islamic scholar Arif Mohammad Khan, coming out all guns blazing against the practice of triple talaq. After Supreme Court's ban on Liquor shops along the highways, the state government is mulling the denotifying of even existing highways. The bar owners, wine merchants in the states have decided to demand denotification of highways as Rajasthan, Madhya Pradesh, Uttar Pradesh and Chandigarh did, hoping to reduce the impact. Fifty Shades of Grey star Dakota Johnson has signed on to star in and executive produce the upcoming historical courtroom drama film Unfit. The film is based on Adam Cohen’s 2016 book “Imbeciles: The Supreme Court, American Eugenics, and the Sterilization of Carrie Buck”. Buck was the plaintiff in 1927 Supreme Court case Buck versus Bell, which she lost.
